Reduced costs for company registrations
There has been a noticeable trend recently toward lowering various administrative burdens on businesses in Poland—as witnessed, for example, by the recent changes in the costs of company registrations.
In 2011, there was a reduction in the costs associated with entries in the Commercial Register of the National Court Register, and the court fees on applications for entries in the register were significantly cut.
Then, on 18 May 2012, an amendment to the regulation of the Minister of Justice concerning publication of Poland’s official judicial and commercial journal, Monitor Sądowy i Gospodarczy, went into effect, reducing the fee for the announcement in the journal of the initial registration of a company and other fees for announcements in the journal.
Registration of a new company in the National Court Register is now subject to a fee of PLN 100 for announcement of the registration in Monitor Sądowy i Gospodarczy (previously PLN 500).
However, companied that filed an application for initial entry in the Commercial Register prior to 18 May 2012 are not covered by the new regulation, and thus they are not entitled to a refund of the difference in the fees even if the entry was made on or after that date. If, however, an application was filed on or after 18 May 2012 and the applicant paid the fee due under the old rules, it is entitled to a refund of the difference, which may be obtained by application to the district court in question.
Following introduction of the changes described above, registration of a new company, including the announcement in Monitor Sądowy i Gospodarczy, costs PLN 600 (a court fee of PLN 500 and a publication fee of PLN 100).
Entry of a change in the Commercial Register concerning existing companies now entails a cost of PLN 500 (a court fee of PLN 250 and a publication fee of PLN 250).
